This data protection statement informs you in detail about how your personal data are treated when using the services offered by LITTLE-BIRD.de's website.

LITTLE BIRD GmbH is responsible for coordinating the portal.little-bird.de online presence (see imprint). Below we present to you how we protect your data and what it means for you as a user of our pages.

Your private and personal data's protection has the highest importance for operation of LITTLE BIRD GmbH's web pages. Data security is ensured by use of the so-called SSL (secure socket layer) process while transferring the data you enter. It encrypts your confidential data before they are sent.

It's important to us that you always know when we store which data and how we use it. Please contact us via e-mail with questions, suggestions, or comments about data protection.

At the address portal.little-bird.de, you can research regional childcare facilities or day care based on your needs and desires, and inform yourself about their services, concepts, and the like. At the same time, available capacities may possibly be displayed.

Use of the following regional online services:

  • participation in the registration process for a care facility or day care person,
  • change-management with the childcare providers, and
  • assessment procedures,

is a service offered by the city for its citizens. It's governed by Social Security Code (SGB) VIII and the state laws for children's day care facilities. Protection of personal data is an important concern for all involved. Therefore, we conduct our internet portal in accordance with applicable laws concerning data protection and data security.

You can visit the portal.little-bird.de website without disclosing any personal information. This applies both to research for available childcare spaces as well as to details about childcare services.

1.1 PERSONAL DATA

Personal data are individual data about the personal or material circumstances of an identified or identifiable natural person. The term 'individual data' is broad and includes any information, particularly e-mail addresses, telecommunication connections, customer numbers, usage patterns, usage permissions, access permissions, pseudonymous, and anonymous name or names of the user, as well as biometric features. Personal data can be divided into inventory and usage data.

Inventory data are personal data necessary for the establishment, content formulation, or alteration of a contractual relationship between the service provider and the user concerning the use of telemedia. This includes in particular your full name, date of birth, and complete mailing address.

Usage data are personal data necessary to permit telemedia use and to bill, to which belong in particular features for identifying the user, information on the beginning, end, and scope of use, and information about which telemedia the user utilizes.

When we use the term 'personal-identity information', information that can be explicitly used to determine your identity is involved. This includes information such as your name, address, and mailing address.

Data not directly linked to your actual identity, such as favourite web pages or the number of users of a page, do not fall into this category.

1.2 COLLECTION AND PROCESSING OF YOUR PERSONAL DATA

We ask for your last name, first name, and other personal information when you register for one of our personalized services, such as the newsletter.

We also request personal information when you use the following online services:

General service

  • Contact with childcare providers
  • Discontinue childcare-provider application
  • Login data
  • Cached data from your service usage

These data are stored on a specially protected server in Germany at the provider 'regio IT' (regio iT gesellschaft für informationstechnologie mbh, Lombardenstr. 24, 52070 Aachen), where we only collect and process all information about your identity if you provide them explicitly. Only employees of LITTLE BIRD GmbH have access to this server. No combination of these data with other data sources is made. Transfer of your personal data to third parties for advertising purposes, etc. is precluded. The number of employees with access to the data is restricted to the minimum necessary. These employees are individually obligated in writing to comply with the data protection regulations.

Only truncated IP addresses and other anonymous data are transmitted to Google, Inc. via Google Analytics for statistical and analytical analysis (also see item 1.5 Cookies).

All data are stored in encrypted form (see item 2. Data security)

Regional service

When you access one of the regional contractual-partner cities' services on the website for your citizens, particularly:

  • participation in the registration process for a childcare facility or day care person,
  • change-management with the care providers, and
  • assessment procedures,

and declare your agreement to it in each case; your data will be stored with the cities in separate databases. Any use of your personal data will be solely for the purpose for which they were collected. Encrypted transmission of personal data (see item 2. Data security) occurs through us to the city. Only separately authorized city employees have access to this server. No combination of these data with other data sources is made.

1.3 USE AND FORWARDING OF YOUR DATA

We only use your personal information in case of

General service

  • contact with childcare providers,
  • discontinue childcare-provider application,
  • login data, and
  • cached data from your service usage,

or during subscription to our newsletter. We will only transferred your data to third parties if your consent is available for the data transfer (e.g. childcare request) or when services are rendered through, and as defined by LITTLE BIRD GmbH. Companies that LITTLE BIRD GmbH entrusts with the provision of services commit themselves to the highest standard of confidentiality while handling your personal data.

The use of regional online services:

  • participation in the registration process for a childcare facility or day care person,
  • change-management with the care providers, and
  • assessment procedures,

or during subscription to our newsletter. We will only transfer your data to third parties if your consent is available for the data transfer (e.g. childcare request) or when services are rendered through, and as defined by LITTLE BIRD GmbH. 1.4 Automatic USAGE DATA

During each access to one of portal.little-bird.de's pages, and during each file retrieval, general data concerning this process are automatically stored in a log file. The IP address is stored in the log file for seven (7) days as a personal identifier in accordance with current law (link). After seven days, the entries are automatically anonymised by irreversibly rewriting (hashing) the IP addresses.

Storage is for purely technical and statistical purposes and to ensure data security so that, for instance, fraudulent data access attempts can be tracked if necessary. Any further disclosure of data to third parties or other assessment will not take place unless there is a legal obligation to do so.

In particular, the following set of data is stored about each retrieval:

  • The retrieving client's complete IP address within the first seven days
  • The retrieving client's anonymised (hashed) IP address after seven days
  • The name of the data retrieved
  • The retrieval's server time
  • Message about whether the retrieval was successful
  • The previously visited page (referrer URL)
  • Description of the type of web browser used
  • Operating system used
  • Search terms with date and clock time

The data are stored on the Little Bird portal server at provider 'regio IT'. Only employees of the LITTLE BIRD GmbH itself have access. No combination of these data with other data sources is made unless there is a legal obligation to do so. We expressly point out that when you visit the web pages, no software, such as spyware, hidden identifiers, or web bugs, is used to create user profiles without the user's knowledge, or to gain access to special information. The only exception to this is the use of 'cookies' for web analysis and web statistics (see below under item 1.5).

Place of storage

Browser data collected are stored on the server of the contracted provider, 'regio IT. Cookies are stored in the Internet user's browser.

Access

Selected employees of Little Bird GmbH employees, who are tasked with the Internet pages' operation and monitoring, have access to the Internet application's server. These employees are obligated to comply with data confidentiality pursuant to section 5 for the Federal Data Protection Act (BDSG).

1.5 COOKIES

In addition, we use so-called cookies in a few areas of our internet service. Such file elements enable portal.little-bird.de to identify your computer as a technical unit to make your use of our service easier—including during repeated visits to our web page. However as a rule, you have the option to set your web browser so that you are informed about the appearance of cookies, and so that you can admit, exclude, or delete cookies already. Please use your web browser's help function to obtain information about changing these settings. We point out that individual functions of our website may not work if you deactivate the use of cookies.

This website uses Google Analytics, a web-analysis service from Google, Inc. ('Google'). Google Analytics uses so-called 'cookies', text files that are stored on your computer and enable analysis of your website use. As a rule, information about your use of this website created by the cookie are transferred to one of Google's servers in the USA and stored there. If IP anonymisation is activated on this web page however, your IP address is truncated by Google beforehand within the European Union's member states or in other states party to the Agreement on the European Economic Area. Only in exceptional cases is the full IP address transferred to one of Google's servers in the USA and truncated there. 1.6 Statistical capture of search behaviour

We reserve the right to store anonymised search behaviour for childcare services as a basis for creating statistics on the demand situation and to offer the latter to affiliated municipalities for capacity planning of their childcare services.

1.8 No liability for partners' pages

We point out that other websites and web services that are accessible through our website have their own data protection guidelines, which are independent of LITTLE BIRD GmbH's. We assume no responsibility or liability for these guidelines and processes, which are not associated with LITTLE BIRD GmbH, nor for contents of any kind presented on these pages.

1.9 RIGHTS OF AFFECTED PERSONS / RIGHT TO WITHDRAWAL

At any time, users can obtain information within the law about or view personal data stored concerning them. If data are incorrect, then affected persons can demand their correction in a proper manner.

At any time, they can withdraw their consent for the collection and storage of their personal data. If an agreement about the use of the data is not explained or is withdrawn, the corresponding data use does not take place. You can then use neither the services offered online to search for available childcare places nor the detailed view of childcare services due to the search query's complexity, but you can personally inform yourself at any time on site about childcare services.

Furthermore, you have the additional right to have the data deleted or blocked. In these cases, please turn to the contact addresses mentioned below.

Data collection, processing, and use occur only to carry out the above-stated purposes.
  • Description of affected groups of people and their related data or data categories, parent and child data, as well as employee data, insofar as these are required for the above-stated purposes.
  • Recipients or categories of recipients with whom the data can be shared, public entities with overriding legal regulations, external contractors according to section 11 of the Federal Data Protection Act (BDSG), external entities and internal departments to fulfil the purposes stated above.
  • Statutory periods for deleting data: the legislature has enacted detailed storage obligations and periods. The corresponding data are routinely deleted after expiry of these periods. Insofar as data are not affected by this, they will be deleted when those under the above-stated purposes cease to apply.
  • Planned data transfers to third-party countries: Data transfer in the USA, specifically for web-analysis provider Privacy Matters c/o Google Inc., 1600 Amphitheatre Parkway, Mountain View, California, 94043, USA is only for analytical and statistical purposes; however it's not being planned anyway. No transfer to additional third-party states is planned.

portal.little-bird.de has the right to change this data protection statement at any time taking applicable legal data-protection provisions into account.

Your personal data are transmitted over the Internet via SSL encryption (AES-256, 256 bit certificate), insofar as you use the online service. You recognise the secure transfer by the protocol identifier 'https' in the URL line, as well as the full domain 'portal.little-bird.de'.

We use technical and organizational measures to secure our website and other systems against loss, destruction, access, modification, or dissemination of your data by unauthorized persons.

Access to your customer account is only possible after input of your personal password. You should always keep your access information confidential and close the browser's window when you've terminated communication with us, particularly if you share the computer with other users.

Data are transferred to the cities in encrypted form. Additional technical measures, such as the use of certificates for authenticating communication partners, also serve to secure the data transfer.

You have expressly granted us the consents below during registration or creation of a childcare enquiry. We have logged this consent. We are obligated to keep the content of the consents available for retrieval at all times. You may withdraw your consent effective for the future.

I am aware that I can withdraw my consent for the collection, storage, and processing of my personal data at any time vis-à-vis LITTLE BIRD GmbH by telephone or per e-mail effective in the future.
